These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and The FBA Company LLC, a Wyoming limited liability company with its registered address at 30 N Gould ST STE R, Sheridan, WY 82801, United States ("Company," "we," "us," or "our"). The Company is operated by individuals residing and working in Latvia, European Union.
By accessing or using the Better Vibe web application available at bettervibe.co (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
Better Vibe is a personal accountability and life-planning tool that helps users track daily commitments across six life domains: Financial, Career, Relationships, Personal, Physical, and Spiritual. The Service includes the following features:
To use the Service, you must create an account through our OAuth authentication provider. You must be at least 18 years of age to use the Service. By creating an account, you represent that you are at least 18 years old and that the information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
The core feature of Better Vibe is the voluntary financial accountability system. By using this feature, you acknowledge and agree to the following:
You may voluntarily set a financial stake amount between $5.00 and $500.00 USD per 30-day cycle. Each cycle begins on the date of your account creation and repeats every 30 days. Within each cycle, you are granted 10 skip-days — days on which you are not required to check in. You must check in on at least 20 out of 30 days in each cycle to avoid being charged.
If you exhaust all 10 skip-days within a 30-day cycle (i.e., you fail to check in on more than 10 days), your full stake amount will be charged to the payment method on file at the end of the cycle. Charges are processed automatically via Stripe.
All accountability charges are final and non-refundable. Once your stake has been charged due to failure to meet the check-in threshold, the charge cannot be reversed, refunded, or disputed through the Service. By setting a stake amount and providing a payment method, you expressly consent to this non-refundable charge policy.
This non-refundable policy exists because the financial consequence is the core mechanism of the Service. Allowing refunds would undermine the accountability system that you voluntarily opted into.
When a stake is charged, 50% of the amount is allocated to charitable purposes and 50% is retained by the Company as a platform fee.
You may modify your stake amount at any time; however, changes take effect only at the beginning of the next 30-day cycle. The stake amount for the current cycle is locked and cannot be altered once the cycle has begun. You may set your stake to $0.00 for the next period if you wish to discontinue financial accountability.
Better Vibe is not a subscription service. There are no recurring monthly or annual fees for using the platform. The only charges that occur are accountability stake charges when you fail to meet your self-imposed check-in threshold. You are in full control of whether any charge ever occurs.
All payment processing is handled by Stripe, Inc. ("Stripe"). By providing your payment information, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your full credit card number, CVV, or card expiration date on our servers.
By saving a payment method, you authorize us to charge the saved payment method automatically at the end of any cycle in which you fail to meet the check-in threshold, without requiring additional confirmation at the time of charge.
You may designate up to two accountability partners by providing their email addresses. By doing so, you represent that you have obtained consent from each partner to receive weekly progress emails on your behalf. These emails include your check-in statistics, skip-days remaining, and stake amount for the current cycle.
We are not responsible for the content of communications between you and your accountability partners. You may remove a partner's email at any time, which will immediately stop future emails to that person.
You retain ownership of all content you create within the Service, including commitments, goals, dreams, journal entries, and other personal data ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.
We do not sell, share, or use your User Content for advertising purposes. Your data is used exclusively to deliver the features of the Service as described in these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Better Vibe is a personal productivity and accountability tool. It is not a financial advisory service, mental health service, or medical service. The Service does not provide professional advice of any kind. You should consult appropriate professionals for financial, medical, or psychological guidance.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You may discontinue using the Service at any time by setting your stake to $0.00 and ceasing to use the platform. If you wish to have your account and all associated data permanently deleted, please contact us at [email protected].
We reserve the right to suspend or terminate your account if you violate these Terms. In the event of termination for cause, any pending accountability charges for the current cycle may still be processed.
We take your privacy seriously. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms.
As the Company is operated from Latvia, European Union, we comply with the General Data Protection Regulation (GDPR) where applicable. You have the right to access, correct, or delete your personal data by contacting us at [email protected].
By using the Service, you consent to receive transactional emails related to your account, including accountability partner progress reports, cycle evaluation notifications, and account-related updates. These communications are essential to the operation of the Service and cannot be opted out of while your account is active.
If you subscribe to our newsletter or marketing communications, you may unsubscribe at any time by following the unsubscribe link in any email or by contacting us directly.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending you an email notification. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Wyoming.
For Users residing in the European Union, nothing in these Terms shall limit your rights under the consumer protection laws of your country of residence, including your rights under the GDPR.
